Abstract

Abstract: : There is no doubt that the term “makhaz” (approach) is the basis of the dispute between those with different opinions. Moreover, it is the foundation on which “ahkam” (rules) and “athar” (impacts) are built. However, it is sometimes necessary to consider the concept of makhaz and its impact in terms of its weakness and strength. Therefore, the study aims to give a quick overview of the concept of “makhaz” and its impact on the dispute between the Shafi’i imams and Imam al-Juwayni regarding the issue of whether or not “ijmal” (abstraction) exists after the demise of the Prophet. We will examine the impact of the term “” of the two groups, and then decide which is more probable. The current study used the qualitative approach based makhaz on the collection of statements and evidence related to the issue, and the analytical approach by analyzing the evidence and looking at the general “makhaz”  on the issue to reach the goal of the study. The findings concluded that not every general “makhaz” had a strong impact. It also argued that such a strong impact in the dispute was due to the ‘makhaz” applied based on looking at its minute details by directing the “makhaz” in a way that makes it suitable for the strong and not the weak impact, otherwise, it becomes subject to criticism and objection. The study highlighted the fact that there has been an agreement that the Prophet passed away after he had clarified everything related to the obligations of religion. In addition, there has been an agreement that the impermissible “ijmal” after the death of the Prophet is related to the obligations while the permissible “ijmal” is not related to the obligations of religion. The Prophet explained the principles whereas the other details and restrictions under these principles were entrusted to the people of firm knowledge to prove them using ijtihad (independent reasoning), examining illah (cause) and other methods of analogical reasoning. According to the findings of the study, the argument that “ijmal” can exist after the death of the Prophet is in fact out of the question as long as it is not related to obligations. It can be also argued that this issue has its benefits in terms of belief and not in terms of usul al-fiqh since no rules will be produced and therefore no outcome can be generated in terms of the latter.
