Abstract: : Scholars have made legal rulings for issuing fatwas and working on issues of dispute so that the dispute is justified and acceptable. Contrasting with the method of the scholars of the ancestors of the nation, and herein lies the problem, and therefore it is important to talk about the controls of the introduction of the concession in matters of dispute. The aim of the research is to clarify the controls for taking the concession and its applications in matters of dispute, using the inductive and analytical approach, so that the researcher reached the most important results: that the legal concession has controls that must be subject to it, and it is capable of separating between real and illusory hardship, and these controls are the original criterion that should be based to him regarding permissible concession and what it is not permissible to do, and that whoever issues fatwas in people’s affairs must encompass these controls so that he does not slip in his fatwa in contravention of the legitimate interest, and that the introduction of the concession with the availability of controls is subject to the five provisions.
