Abstract

Abstrak: Kedudukan wakaf telah termaktub dalam Perlembagaan Persekutuan iaitu Senarai Negeri, Jadual Kesembilan, manakala di setiap negeri dimuatkan pula dalam Enakmen Wakaf Negeri dan Enakmen Pentadbiran Hal Ehwal Islam Negeri. Ini menunjukkan kedudukan wakaf adalah penting peranannya di negara ini. Namun demikian, masih terdapat kekeliruan bagi Mawqūf ʽAlaīh terhadap kefahaman wakaf khususnya kedudukan wakaf am dan wakaf khas di Terengganu. Objektif kajian ini menfokuskan kepada terhadap perbezaan bagi pelaksanaan wakaf di Terengganu khususnya kedudukan wakaf khas dan wakaf am. Seterusnya mengkaji implikasi kedua-dua wakaf tersebut terhadap implikasi mawquf alaih. Kajian ini dilaksanakan melalui kaedah kualitatif dengan mengunakan reka bentuk penerokaan. Kajian ini juga turut melibatkan kajian lapangan iaitu proses temu bual, manakala teknik analisis pula mengunakan melalui kaedah analisis kandungan. Dapatan kajian menunjukkan bahawa pelaksanaan wakaf am dan wakaf khas mempunyai implikasi yang berbeza dari sudut hasil daripada Mawqūf ʽAlaīh. Implikasi wakaf khas adalah lebih kecil berbanding wakaf am iaitu penerima wakaf khas hanya tertumpu mengikut hasrat pewakaf manakala wakaf am pula melibatkan skim bantuan di bawah pengurusan MAIDAM. Rumusan kajian ini adalah penting untuk menjelaskan segala kekeliruan yang ada dalam kalangan masyarakat dan juga memberi impak positif terhadap tadbir urus di MAIDAM.

Abstract: The position of waqf has been dictated in Federal Constitution which is in State List, Ninth Schedule, while for each state is mentioned in State Waqf Enactment and State Islamic Affairs Management Enacment. This indicates that the position of waqf role is important in this country. However, there are still confusions for mawquf alaih on waqf understanding especially the position of general waqf and specific waqf in Terengganu. The objective of this study is to focus on the difference of waqf implementation in Terengganu especially the position of general waqf and specific waqf. The second objective is to investigate the implications of both waqf upon mawquf alaih implications. This study was performed through qualitative method employinh exploratory design. This study also involved field study which was interview process, while analysis technique was through content analysis method. The findings of study pointed that implementation of general waqf and specific waqf posed different implications from aspect of result from mawquf alaih. Implication of specific waqf was smaller compared to general waqf where the receiver of specific waqf was only focused according to the intention of waqf giver while general waqf involved aid scheme under MAIDAM management. The conclusion of this study is significant to explain the confusions among community and also bring positive impact upon administration in MAIDAM.
